Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Fuel Smart mobile application (the "App"), including any related services, features, and content provided by Fuel Smart PH ("we", "us", or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. About the App

Fuel Smart helps users discover fuel stations on a map, view and compare fuel prices, save favorites, and contribute updates or reports. Certain information in the App is contributed by users (crowdsourced) and may change over time.

You understand and agree that crowdsourced and third‑party information can be incomplete, outdated, inaccurate, or unavailable at any time. We continuously work to improve data quality and reliability, but we do not guarantee accuracy or availability.

2. Eligibility and Account

• You must be legally capable of entering into a binding agreement under applicable law.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must provide accurate information where required and keep your account details reasonably up to date.

3. Crowdsourced Data, Reporting, and Community Features

The App relies in part on user submissions (e.g., price updates, station location reports, and problem reports). These submissions may be reviewed, verified, moderated, aggregated, edited, or rejected.

If you believe information displayed in the App is incorrect or problematic, you may use the in‑app report feature associated with a to submit a report. This helps us and the community improve data quality.

You agree to submit only truthful, accurate, and good‑faith reports.

4. Acceptable Use

• Do not submit false, misleading, abusive, or malicious reports or content.
• Do not attempt to exploit, reverse engineer, disrupt, or interfere with the App or its systems.
• Do not use the App in a way that violates laws, regulations, or third‑party rights.
• Do not scrape, copy, or harvest data from the App at scale without our written permission.
• Do not impersonate others or misrepresent your identity or contributions.

5. Crowdsourced Submissions; Ownership of Produced Work

"Crowdsourced Submissions" include any price updates, station/location reports, issue/problem reports, confirmations/denials, votes, comments, and related information or metadata you submit through the App.

As between you and Fuel Smart PH, all Crowdsourced Submissions you provide through the App and all resulting outputs created from them—whether verified, aggregated, edited, scored, moderated, or otherwise processed (collectively, the "Produced Work")—are and will remain the exclusive property of Fuel Smart PH.

To the maximum extent permitted by applicable law, you hereby irrevocably assign and transfer to Fuel Smart PH all right, title, and interest that you may have in and to your Crowdsourced Submissions and the Produced Work, including any intellectual property rights that may exist in them.

If any portion of the assignment above is not enforceable in your jurisdiction, you instead grant Fuel Smart PH a perpetual, irrevocable, worldwide, royalty‑free, transferable, sublicensable license to use, reproduce, store, host, adapt, modify, translate, publish, create derivative works from, distribute, display, and otherwise exploit your Crowdsourced Submissions for any purpose related to operating, improving, securing, moderating, and promoting the App and its services.

You acknowledge that we may review, verify, modify, combine, de‑duplicate, reject, remove, or limit access to Crowdsourced Submissions at our discretion, including to protect data quality and prevent abuse.

6. No Professional Advice

The App is provided for informational purposes only. Any decisions you make based on the App (including travel, routing, purchasing, or pricing decisions) are at your own risk.

7. Disclaimers (No Warranty)

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, Fuel Smart PH DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, error‑free, or that any information (including crowdsourced data, forecasts, station information, prices, or availability) will be accurate, complete, or up to date.

8. Limitation of Liability

To the maximum extent permitted by law, we are not responsible or liable for any inconvenience, loss, damages, injury, claim, or expense arising from or related to your use of (or inability to use) the App, including reliance on any information displayed in the App.

This includes, without limitation, indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, business interruption, route deviations, missed appointments, or any damages arising from inaccurate or delayed crowdsourced information.

If applicable law does not allow certain limitations, our liability will be limited to the minimum extent permitted by law.

9. Third‑Party Services and Links

The App may integrate with third‑party services (e.g., map providers, authentication providers, analytics, crash reporting, or backend services). Your use of those services may be subject to their terms and policies. We do not control and are not responsible for third‑party services.

10. Enforcement, Suspension, and Termination

We may investigate suspected violations and take action at our discretion. We may warn, restrict features, suspend, or terminate your account, and/or ban you from the App if we reasonably believe you:

• repeatedly submit incorrect, bad‑faith, abusive, or fraudulent reports;
• attempt to exploit vulnerabilities or break the App;
• engage in harassment, spamming, or other harmful conduct;
• violate these Terms or applicable law.

We may also remove or limit access to any content or contributions that violate these Terms or that we believe may harm the community.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share information.

12. Changes to the App or Terms

We may update the App and these Terms from time to time (for example, to reflect new features, legal requirements, or security updates). Updated Terms will be posted in the App or otherwise made available to you. Your continued use of the App after an update means you accept the updated Terms.
